Exactly What Is A Mining Claim

Mining claims allow people to extract items of value from land.


A mining claim can be described as a parcel of land on which people assert that they own the land and have a right to mine, develop and excavate for items of value within the mine or on the property. A mining claim does not include exclusive surface rights. There are two types of claims, placer and lode.


Placer Claims


A placer claim includes the deposits that are not subject to lode claims, such as the deposits of unconsolidated materials. These materials include gravel and sand that contain free gold or any other mineral. Other placer claims may include nonmetallic bedded or layered deposits, such as high-calcium limestone or gypsum.


Lode Claims


Lode claims are where the deposits include classic veins or lodes that have well-defined boundaries. This includes rocks that are in place and that contain a valuable mineral. Another example of a lode claim includes quartz contained inside boulders on the property.


Patented Claims


A patented mining claim is where the federal government passes its title to the claimant, which makes the land private. This gives the land owner rights to all minerals found.


Un-Patented Claims


Un-patented mining claims occur where a parcel of federal land is valuable for mineral deposits or other deposits that may be found.


Geography


There are 19 U.S. states where mining claims can be found. Some of these include New Mexico, Mississippi, South Dakota, Florida and Louisiana.
